COVID-19 presents unprecedented challenges to institutions of higher education. Institutions created to bring people together and encourage the free exchange of their ideas must now learn to serve their students, faculty, and other stakeholders safely during a pandemic where gathering in-person may be dangerous in and of itself. To ensure that institutions of higher education resume in-person operations in as safe a manner as possible, New York State is requiring all higher education institutions to prepare a reopening plan. The reopening plan must comply with the guidance recently issued by New York State and must be submitted to the New York State Department of Health. On top of the challenge of reopening safely, COVID-19 and the measures taken to address it increase the exposure of institutions of higher education to class action lawsuits.
