NY Judges Question GOP Arguments Against Mail-In Ballot Review
Republicans in New York State are challenging part of the state’s election law which allows local election boards to consider an absentee or mail-in ballot valid (and count the vote), even when there is a split between democrat and republican representatives about whether the ballot envelope is valid.
GOP representatives tried to convince judges on New York’s highest court that the law permitting the counting of questionable mail-in ballots is unconstitutional, saying it gives the upper hand to one political party. Two Court of Appeals associate judges questioned that argument, saying the law applies to both parties.
Christopher Massaroni provided insight into what a successful challenge would mean to not only mail-in ballots, but also in-person voting.
