New York Court Sides with Masons in Property Exemption Suit

Tax Notes State highlighted a case in which Hodgson Russ LLP attorneys obtained a favorable outcome for their client.

Daniel Spitzer and Henry Zomerfeld secured a victory for the Trustees of the Masonic Hall and Asylum Fund (the “Masonic Hall") against the Town of Henrietta. The Town denied the Masonic Hall a Real Property Tax Law Section 420-a non-profit property tax exemption. Monroe County Supreme Court (Doyle, J.) granted the relief sought in the petition and held the denial of the exemption was unlawful, awarded the property tax exemption, granted refunds of property taxes with statutory interest, and, notably, granted costs and disbursements against the Town. The decision results in a combined refund of Town, County, and School District taxes in excess of $88,000.
