Trademark Trial and Appeal Board Trial Win

Hodgson Russ, on behalf of clients SFA and SaniFlo Inc., successfully cancelled the trademarks SANI MOVE and Design and SANIMOVE in the name of Sa Wang, a Chinese national. We obtained evidence during discovery showing that the registrant failed to commence use of the marks in interstate commerce as claimed, and not within the requisite time periods. As a result, the TTAB cancelled the challenged marks as being void ab initio.
