Development of a Licensed Home Care Services Agency 

Hodgson Russ is assisting in the development of a licensed home care services agency (LHCSA) as a joint venture between two continuing care retirement communities (CCRCs). The engagement involves analyzing the applicable regulatory structure, negotiating the agreements and assisting with the filing of the certificate of need applications to obtain regulatory approval for the joint venture. This matter falls within a narrow exception to the general requirement to demonstrate public need to for the establishment of a new LHCSA and, insofar as we are aware, represents the first joint venture CCRC-based LHCSA in New York. As such, it is poised to become a model for the development of similar joint ventures in the future.
