Comprehensive Restructuring of Affiliation Relationships for Hospital System and Physician Practice

We represent a hospital system and a large physician practice in a comprehensive restructuring of their affiliation relationships. The project involves advice on the federal and state laws addressing physician compensation and referral relationships (including the Stark Law, the Anti-Kickback Statute and their New York counterparts). In addition, the project involves a comprehensive review of the qualifications of physicians to participate in the practice and the documentation setting out the relationship between the system and the practice. This matter is important because the process for engaging qualified physicians is complex and directly affects the hospital’s ability to carry out its mission to provide health care in the community.
