New York Court of Appeals Reverses Fourth Department Order 

Hodgson Russ secures reversal of a Fourth Department order from the New York Court of Appeals on behalf of IDA client. The Fourth Department determined the IDA was liable for potentially millions of dollars of unpaid water charges and penalties related to a manufacturing facility that had received IDA incentives. The Court of Appeals unanimously held that the water regulations and state statutory provisions, upon which the plaintiff relied, did not authorize a claim for personal liability and ruled in favor of our client.
