Outside Environmental Counsel to National Solar Energy Facility Developer

Our firm acts as outside environmental counsel to a national solar energy facility developer that focuses on the siting of projects on low-value land, closed landfills, brownfields, and other potentially impacted/blighted sites.  We advise the client on all aspects of siting and site control associated with these sites.  In the environmental context, we are currently advising the client on potential environmental risks and general environmental and regulatory compliance and risk management considerations associated with the development of projects on several closed landfills, including two federal Superfund sites subject to significant ongoing operations and management obligations.  This requires the need to negotiate, and work cooperatively with, among others, groups of potentially responsible parties (“PRPs”), that have active environmental obligations with the site, as well as federal and state regulators.
